Legal Bases to be Envisaged in Cases of Subject Matter for Returning the Excise Tax Sums

The use of the excise tax in our legislation has some inconsistencies, which also contradicts the internationally accepted approaches of consuming taxes. In the phase of re-exporting from our country the goods subject to taxation by the excise tax being imported to Armenia, the excise tax paid during the import is not returned with the current regulations. Thus, it is proposed to rectify the regulation, designing a legal basis for returning the sums of the excise taxes in the cases of subject matter. The RA Deputy Minister of Finance Arman Poghosyan said about this presenting to the parliament in the first reading the draft law on making Amendments and Addenda to RA Tax Code.

The issue was debated during the RA NA extraordinary sitting on November 24.

It is proposed by the draft to reserve competence to the Government to set the amount of the excise tax, the cases and the order.

“On the consideration of forming more convenient tax environment it is proposed to give an opportunity for the goods that are imported, but are designed for further re-exporting, not to be subject for excise stamping. The excise stamps are tools of control towards the realizing or circulating goods in the Republic of Armenia,” Arman Poghosyan gave details.

At the request of the Deputy Chair of the Standing Committee on Economic Affairs Babken Tunyan, Arman Poghosyan presented clarification why the setting of the amount of the excise tax, the cases and the order is reserved to the Government. According to him, the regulation is completely new, and there is need for working more detailed, including the parliament, to understand the argued amount. The Government expressed readiness to move the regulations later to the Tax Code for having more stable and predictable environment.

The member of the Standing Committee on Economic Affairs Karen Hambardzumyan presented the endorsement of the Head Committee.

The draft was adopted in the first and second readings.
